I was in court in Mississauga today with yet another innocent person who has been turned into a criminal for no reason. We were there to set a date to set a date. The wheels of pseudo-justice grind slowly indeed.
The JP said, only about this case and no others "These are very serious charges". That's right. Owning a dog you got as an 8-week-old puppy as a gift from a relative, training him, socializing him, caring for him and taking him to be neutered at about the right age is a serious crime in the Formerly Democratic Republic of Ontaristan. I'm ashamed of what this place has become and I'm sure my Empire Loyalist ancestors are screaming in their graves. Not to mention my gang-bangin', mutha-humpin' lowlife forbears who were Irish back when that meant you were automatically a second-class citizen. You listening, McGuinty? More later. It's funny, I've been thinking that Caveat was looking a bit square and maybe I should redesign it but most of all I want it to be easy to read so I've avoided it for a long time now. According to K9 officers in Chicago, whose unit uses the traditional German Shepherd Dogs and even has a Bloodhound on staff, 'pit bulls' are a problem for the force.
A pit bull named Elliot Ness is anything but untouchable. Loving and friendly, these traits keep most pit bulls from being good police dogs. "The main problem we're finding with pit bulls is that they're too darn nice. All they want to do is just sit at your feet or crawl in your lap. They're very nice dogs," said Deborah Thedos, Cook County K9 Unit. Police officers main contact with pit bulls is when they break up dog fighting rings. When encountering these dogs they found that they were anything but vicious. "We knew from the get-go that these dogs, they aren't made this way," said Sheriff Tom Dart, Cook County. For Elliot Ness's partner the pit bull is much more than just a dog. "He's my best friend. He's my friend. He's my baby and he knows it," said Thedos . Here's the whole item, with accompanying video. That line by the late, great Frank Zappa never fails to crack me up. I wrote to the House Reps in Montana the other day (full list of email addresses is available at No Pit Bull Bans). It wasn't one of my better missives but I wrote it and sent it, poor phrasing and all. I didn't cover a lot of the aspects of why BSL is a huge mistake, but I did send along at least some information which the Committee may find helpful. I got a very speedly reply from Representative Becker, who is opposed to the concept of BSL and understands that it is owners, not dogs, that cause problems when they ignore local regulations. The Rottweiler Club of Canada, Saluki Club of Canada, Manchester Terrier Club of Canada, Pomeranian Club of Canada, the Thousand Island Kennel Club and a lot more clubs and individuals from across the country have jumped on board to help us defeat breed-specific laws in Canada. Businesses are onside, donating money to the cause. Lori has the information over at Wag the Dog. If you live in the Peterborough area, Boston Pizza, the north location only, is donating 10% of all sales from this Saturday, January 17 to Banned Aid! Donations are coming in quickly - a huge thanks to everybody who has helped at this crucial time. At the end of January we will complete a detailed list of everyone who has contributed to the legal fund. Otherwise, we'll forget somebody and we don't want that to happen because every single person who has come to the aid of this case both now and in the past deserves a pat on the back. I note that nobody enthused over the stunning Bone-O-Meter I created, mostly by hand. Fancy software? We don't need no stinkin' fancy software. We don't like to waste money. It all goes to the court, the lawyers and the experts - because what we need is to win this case and have the cruel, thoughtless and useless Ontario ban on domestic dogs struck down, torn up, set on fire and pissed on by 'pit bulls'. According to a story appearing in the New York Times this week, the U.S. Supreme Court may soon hear an unusual First Amendment case
that could put some high-profile animal rights groups out of business.
And they don't even seem to see it coming. The case surrounds a
1999 federal law that criminalized the creation, sale, or possession of
videos and photos depicting animal cruelty for commercial gain. The law has since been struck down, but now the Humane Society of the United States (HSUS)
is rallying support to restore it because it made distributing
dogfighting videos [...] illegal.
We have just one question: Is fundraising to foot the bill for
six-figure activist salaries considered "commercial gain"? I agree with those dastardly villains at CCF that this raises a very interesting point.Since most of the fundraising efforts of the pseudo animal welfare groups such as the Hsus and Peta involve using the shock value of stock graphic images, if they are successful in reinstating the law prohibiting the use of such images for commercial purposes, it would only make sense that they'd have to shut down this very lucrative aspect of their fundraising efforts. Since I don't care a whit for people who abuse animals, and have even less tolerance for those who peddle what I call cruelty porn regardless of who they are, I'm hoping they all lose out, big-time. I don't see this as a freedom of speech issue, since the speech in this case involves documentation of a felony and its subsequent distribution for financial gain. It should therefore not be protected under freedom of expression rights, in my opinion. There is a slight problem with that line of thinking though. Unless the law is surgically applied to cover only the kinds of graphic images discussed, it could easily include books, newspaper and journal articles and even movies that are produced about real crime situations. In fact, I can see how it might even extend to fictional creations. That's the trouble with these kinds of knee-jerk ideas, there's always another angle. Hats off to the Saluki Club of Canada. They have donated $1,000 to the Ontario legal fund and have issued a challenge to other breed clubs to do likewise.
Here's the note they sent out and apparently it's spreading fast: The Banned Aid group is trying to raise another $67,000 in the next two weeks to take OUR breed-specific-legislation fight to the Supreme Court of Canada. In time, this legislation WILL affect all dog owners – and breeds – across Canada. Italy’s initial list of just 13 breeds has exploded to 96, and now includes the Bernese Mountain Dog, Collie, Sheltie, Corgi, Old English Sheepdog, Berger des Pyrenees, Newfoundland, St. Bernard, Leonberger, Boxer and Australian Shepherd, to name just a few. These last five breeds, along with 70 other breeds, already appear on lists right here in North America! WE CAN’T AFFORD NOT TO DO OUR PART. Over the past few years, the Saluki Club of Canada and many of its members have financially supported this fight. At our recent AGM in December we increased our pledge to $1,000! Sheesh, don't they have enough to worry about in California these days? They seem to spend a lot of time and effort on meddling with what wasn't broken in the first place.
From No Pit Bull Bans: By a 4-1 vote at its regular board meeting Dec. 17, the Ukiah City Council directed staff to draft an ordinance to be brought back for final approval at a later date mandating the change of the word “owner” to “guardian” in city code regarding canines. Councilmember Doug Crane said he could not stand behind the intentions of the actions because it would lead to more problems down the road. “I went online and asked the difference between ownership and guardianship,” he said, making himself the lone voice of dissent to the idea on the board. “I found several links to PETA. If you’ll remember, PETA has stated several goals: no pets, no zoos, no eating of animals, no use of leather. A complete paradigm shift in this society and strategically if communities across the country change this language in decades it will be enough communities that it’s critical mass, then the (law)suits will begin. " [snip] Councillor Crane sounds like a smart guy. I wish we had more politicians of his calibre out there. There's more info at the link. Guardianship is a strange concept indeed. While obviously, most of us think of our dogs as important members of the family who need of our care and protection, changing their status from property is a very dangerous idea. But it isn't really guardianship in the true sense that the animal liberationists want. It's really just the removal of property rights around dogs, which would ultimately make it much easier to seize pets from responsible homes and kill them. It's the same idea as a breed ban in that it feeds the ultimate goal of an end to animal ownership and eventually, domestic animals. If I am legally, rather than philosophically, the guardian of my dog then there are certainly questions that would need to be answered. Would I need their consent to perform euthanasia in times of extreme, irremediable suffering, or does my 'guardian' status grant me power of attorney as well? The same question arises with respect to performing invasive, life-altering surgery on a healthy animal. Would I have the right to neuter my dog without his or her consent? Would a breeder have the authority to place puppies in suitable homes or would there have to be some kind of agency that would hold hearings on puppy placements? Would it become illegal to buy and sell dogs? Would I be obligated to hire a caregiver if I had to be at work or go on vacation? Could I still board my pets at their regular kennel? How about using a crate? Walking with a leash and collar? Obedience training? If I died intestate and had no human family would my estate automatically transfer to my dependents, in this case my pets? Do I need to appoint a trustee to look after my dogs when writing a will? At what age do dogs become 'adults' or are they considered dependent for life? Would I be exposed to impromptu visits by animal welfare agents who would decide whether or not my 'guardianship' was up to snuff? Would that change the status of my dog licence? I presume that there would be no more licensing or microchipping, since that is an affirmation of ownership. There are many other questions that arise, I'm sure you have considered them. The whole guardian idea is a very bad one, in my opinion, and is just one more example of government busybodies being manipulated by fanatics into buying a pig in a poke - in this case, the animal liberationist ideology. My miniature Cymbidium finally flowered Well, I think that was a first for me. I only turned my computer on once between Christmas Eve and tonight. It was relaxing living in 3D for a change and what's more, I didn't watch much news at all over the past 11 days. I haven't read any blogs either. Tomorrow, I'll be catching up with all the reading I've missed to see how my invisible friends are faring. Of course, I'll be checking the news hits too so my calm state of mind will undoubtedly evaporate. In the meantime, let's hope that this year is great for everybody on the good side of things and very bad for the villains. Best wishes to all for happiness and success in 2009. |
